Personally I don't support him, as a person, nor what he did as being a good thing... BUT... what he did was NOT illegal based on the law at the time. Back then there was the concept of "personal responsibility". If someone freely went somewhere and freely got "hammered" and then, while "hammered" freely participated in things... well... they were held responsible for the consequences of their actions that all stemmed from the first action of participating in going there and getting hammered in the first place. |

They knew that they were going to a "party location"... and those types of parties were always including "mind altering" substances... whether alcohol or drugs is irrelevant. What's important is that it was no surprise that altered states of consciousness regularly occurred at the gatherings. No one forced anyone to attend. And by the laws of the day (and the laws that should still exist) your free choice to attend meant your acceptance of the consequences OF attending... whatever they may be. ETA: and "a person can't consent to sex" is a stupid idea. By that logic a person can't consent to drive a car either... yet we still hold them responsible for driving. |
